
Terms and conditions
I. General
1.1 These Terms and Conditions (“Terms”) apply to all photoshoots, quotes, and services provided by photographer Dirk Murrnautzky (hereinafter “Photographer” or “DM”) in Thailand.
1.2 These Terms become effective upon booking—whether made in writing, by phone, or via email—and, at the latest, upon the Client’s acceptance of the delivered images.
1.3 Any conflicting or additional terms proposed by the Client are expressly rejected unless the Photographer has agreed to them in writing.
1.4 In the event of an ongoing business relationship, these Terms shall apply to all future assignments without needing to be renegotiated.
II. Delivered Image Material
2.1 These Terms apply to all images delivered to the Client, regardless of format or transfer method (e.g., digital files, prints).
2.2 The Client acknowledges that all delivered images are protected by copyright under applicable laws.
2.3 Image files will be provided digitally in the agreed resolution and file size.
2.4 Any complaints regarding the content, quality, or condition of the delivered images must be submitted in writing by email to info@fotoshooting-thailand.com within 24 hours of receipt. If no complaint is received within this timeframe, the images shall be deemed to have been delivered in accordance with the contract.
2.5 Once digital files have been provided, there is no right of withdrawal.
III. Usage Rights
3.1 Upon full payment of all fees, the Client receives a non-exclusive, worldwide, and unlimited right to use the delivered images.
3.2 Any transfer or sublicensing of usage rights to third parties requires the Photographer’s prior written consent.
3.3 Whenever the images are published or shared, the Client shall credit “Photography by Dirk Murrnautzky” in a reasonable manner.
IV. Fees & Payment Terms
4.1 The fees shall be as individually agreed upon. All prices are quoted in Euros (€) or Thai Baht (฿), plus any applicable taxes.
4.2 Any discounts or special rates are only valid if confirmed in writing by the Photographer.
4.3 Invoices are payable without deduction within 14 days of the invoice date.
4.4 In the event of late payment, the Photographer may charge interest of 5 percentage points above the applicable base interest rate. Additionally, a reminder fee of €12.50 (or its local equivalent) will be charged per written reminder.
V. Cancellation & Rescheduling by the Client
5.1 Failure to appear on the agreed shoot date does not release the Client from payment obligations.
5.2 The Client may cancel without penalty up to 14 days before the scheduled shoot date. Any booking fees or deposits already paid will not be refunded.
5.3 If the Client cancels less than 14 days before the shoot date, the full agreed fee becomes due. The Photographer will offer to reschedule within the same calendar year, subject to availability, but the original fee remains payable by the original shoot date.
5.4 In case of the Client’s illness or other unavoidable personal circumstances, there is no automatic right to a refund. The Client may cover potential losses through travel or event insurance. The Photographer will offer a substitute date if possible, but the fee remains due as outlined above.
5.5 Vouchers, gift certificates, or promotional credits are non-refundable and cannot be redeemed for cash.
VI. Right of Withdrawal
6.1 No statutory right of withdrawal applies to digital image deliveries.
6.2 The Client may nevertheless cancel the contract up to 14 days before the first agreed shoot date by sending an email to info@fotoshooting-thailand.com. A written confirmation of the cancellation will be sent by email.
VII. Liability
7.1 The Photographer’s liability is limited to cases of intent or gross negligence.
7.2 The Photographer is not liable for any loss or damage incurred during travel to or from the shoot location, or for personal items brought by the Client or subjects.
7.3 Liability for slight negligence is excluded, except in the case of breach of essential contractual obligations (“cardinal obligations”). In such cases, the Photographer’s liability is limited to the typically foreseeable damage.
7.4 Mandatory statutory liability (e.g., in cases of personal injury or product liability) remains unaffected.
VIII. Final Provisions
8.1 Any amendments or side agreements must be made in writing to be effective.
8.2 Should any provision of these Terms be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that most closely aligns with the economic intent of the original.
8.3 Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Florida, USA. Any dispute arising out of or in connection with these Terms shall, unless resolved amicably, be submitted to the competent courts located in Miami-Dade County, Florida, USA.
